Abstract
La presente tesis doctoral aborda el análisis de las especialidades de jurisdicción y competencia contenidas en la Ley 14/2014, de 24 de julio, de Navegación Marítima con especial atención a la oponibilidad frente a terceros de las cláusulas de sumisión expresa insertas en conocimientos de embarque tras la aprobación de dicha Ley y cuando el tribunal designado pertenece a un Estado miembro de la Unión Europea. Para ello se ha procedido al estudio de la jurisprudencia recaída sobre la materia con anterioridad al año 2014 para determinar el anterior régimen de oponibilidad. Seguidamente, se han estudiado las resoluciones posteriores a dicho año para determinar el grado de cambio en dicho régimen. Junto con lo anterior, se ha realizado un resumen de las principales posturas críticas que sobre la materia ha expresado un sector muy autorizado de nuestra doctrina científica mercantil. Todo lo anterior ha sido estudiado desde la perspectiva del transporte marítimo de mercancías.
The present Ph.D. thesis tackles the analysis of the jurisdiction and competence specialties contained in Spanish Maritime Act No. 14/2014, July 24th, with special attention to the enforceability against third parties of the jurisdiction clauses inserted in Bills of Lading after approval of said Act and when the designated court belongs to a Member State of the European Union. To this end, a study of the case law on the matter prior to 2014 has been carried out to determine the previous enforceability regime. Thereupon, the case law after said year has been studied to determine the degree of change in said regime. Along with the above, a summary has been made on the main critical positions that a highly authorized sector of our Trade Law scientific doctrine has expressed on the matter. All the above has been studied from the perspective of the carriage of goods by sea.
