Abstract
La hipótesis de trabajo de nuestra Tesis es: ¿hasta qué punto hubo grupos, minorías o colectivos que tuvieron un tratamiento jurídico diferenciado y desigual en la práctica notarial de la Edad Moderna? Para resolverla nos hemos servido de una de las fuentes más importantes para el conocimiento de la aplicación pacífica del derecho, los protocolos notariales. En todo caso nuestro estudio constituye un primer acercamiento abriendo una línea de investigación pues no se nos oculta que queda mucha labor de archivo por hacer. Amén de esa hipótesis, de manera subsidiaria abordamos otros dos objetivos: de un lado mejorar el conocimiento de la labor notarial de los escribanos de la Edad Moderna incidiendo en el estudio de aquella documentación por ellos autorizada que tenía como destinatarias a las capas más desfavorecidas de la sociedad de entonces, y, por otro lado, la inevitable comparación entre la práctica de aquellos escribanos y el notariado actual, estudiando el cambio y la evolución experimentados y ello pese a ser conscientes que, por su total falta de sincronía, se dan circunstancias radicalmente divergentes entre una y otra sociedad...
The working hypothesis of our thesis is: To what extent were there groups, minorities, or collectives that received differentiated and unequal legal treatment in early modern notarial practice? To answer this question, we have used one of the most important sources for understanding the peaceful application of law: notarial protocols. In any case, our study is a first approach, opening a line of research, as we are aware that much archival work remains to be done. In addition to this hypothesis, we also address two other objectives: on the one hand, to improve knowledge of the notarial work of the scribes of the Modern Age by focusing on the study of the documentation they authorized and which was addressed to the most disadvantaged sectors of society at that time, and, on the other hand, the inevitable comparison between the practice of those scribes and the current notary profession, studying the changes and evolution they underwent, and this despite being aware of the radically different circumstances between one society and the other...
