Abstract
La evolución de la mundialización ha supuesto un recíproco proceso de constitucionalización del derecho internacional público e internacionalización del derecho
constitucional, a medida que se desarrollaba el ejercicio de la gobernanza global.
El constitucionalismo global es una de las perspectivas que mayor éxito se ha granjeado como instrumento de estudio de este fenómeno, especialmente en las literaturas anglosajona y germana. A pesar de ello, continúa sin contar con una definición
consensuada y sin que se haya establecido con exactitud su ámbito. Este artículo
tiene como objetivo analizar este neologismo y sus múltiples significados, recogiendo
las propuestas que se han identificado como más relevantes. Tras su diferenciación
con respecto al concepto próximo de derecho constitucional internacional, se utiliza
una lógica binaria para ordenar los discursos que afirman o niegan la posibilidad yconveniencia de trasladar a un contexto global y de pluralismo jurídico los tópicos
tradicionales del constitucionalismo
The evolution of globalisation caused a reciprocal process of constitutionalisation of the International public law and internationalisation of the Constitutional law, at the same time that the exercise of global governance was developed. Global constitutionalism is one of the most successful approaches so far as a means to study this phenomenon, especially in the English and German literatures. In spite of this fact, it still lacks an agreed definition, and it continues without establishing what its scope is. The objective of this article is to analyse this neologism and its several meanings, collecting the most relevant contributions. After distinguishing it from the close concept of international constitutional law, a binary logic is applied to ordering the approaches that defend or deny the feasibility and convenience of translating the constitutionalism’s traditional topics to a global context of legal pluralism.
