Abstract
El presente trabajo pretende analizar los elementos clave del acoso y el ciberacoso, sus definiciones, requisitos, características y sujetos; el tratamiento del ciberbullying a nivel europeo y nacional, centrando el foco en la calificación jurídica del ordenamiento jurídico español ante este tipo de comportamientos y la responsabilidad derivada de la conducta de los menores desde la penal (propia del menor) hasta la civil o incluso la administrativa. Se examinarán brevemente otros tipos de conductas cibernéticas en la red (por sus características son incompatibles con el ciberacoso), así como los protocolos de actuación y prevención para impedir su desarrollo. Finalmente, se abordará la necesidad de una mejora educativa y un desarrollo legislativo más amplio en materia de prevención, protocolos e incluso una propuesta de reforma del CP.
This bachelor thesis aims to analyze the key elements of bullying and ciberbullying, including their definitions, requirements, characteristcs and involved parties, as well as the legal treatment of ciberbullying at both European and involved parties; as well as the legal treatment of ciberbullying at both European and national levels , focusing on its legal classification within Spanish legal system anf the liabilities arising from behavior Of minors, from criminal (specific to minors) to civil or even administrative responsability. Other forms os online criminal behavior will be briefly examined (as their characteristics make them incompatible with cyberbullying) along with the protocols for action and prevention designed to curb their development. Finally, the bachelor thesis Will addres the need for improved education and broader legislative development in termins of prevention, intervention protocols and even a proporsed reform of Criminal Code.
