Abstract
El artículo analiza el fenómeno de la llamada “Pena de Telediario”, entendido como el juicio paralelo mediático que afecta a personas o empresas involucradas en procesos judiciales antes de que exista resolución firme. A través de un análisis de contenido de los informativos de La 1 de TVE durante 2023, se identifica la presencia y el impacto de casos judiciales destacados cuya cobertura puede generar consecuencias personales y sociales para los protagonistas. El estudio define criterios para distinguir la pena de telediario, cuantifica los casos emitidos y sus víctimas, y reflexiona sobre las implicaciones éticas, comunicativas y jurídicas de este tipo de condena pública. El trabajo insta a diferenciar la responsabilidad mediática y la protección de la presunción de inocencia frente al daño reputacional.
This paper examines the phenomenon known in Spin as “Telediario Punishment”, a type of media-driven parallel judgement that affects individuals or companies involved in judicial proceedings before any final court ruling is issued. Through content analysis of the main Spanish Public TVE newscasts (La 1) in the year 2023, the study identifies the presence and impact of prominent legal cases and the consequences that extensive news coverage can have on their protagonists. Clear criteria are established to define telediario punishment, quantify the broadcast cases and victims, and discuss the ethical, communicative, and legal implications of such public condemnation. The work argues for distinguishing media responsibility and protection of the presumption of innocence to prevent reputational damage.
